Eviction Service

Thank you for inquiring about Courtesy Eviction Service. We offer an array of services to Landlords, Mobile Home Park Owners, Commercial Real Estate Managers, and REO managers. We have been in business for over twenty years and handle eviction cases for the South Florida area.  Courtesy Eviction Process Service has been serving the legal community as well as the private sector in the Miami, Florida area.

We understand.  You want to kick your tenant out, and you have no idea where to start.  You have come to the right place.  Why do you want to evict your tenant?  Does your tenant owe you rent?  Did they violate the terms of the rental agreement?  Did they move in unauthorized occupants?   Did his lease expire, and they's still in the property?  Or do you simply want the property back for you own personal use?  Whatever the reason is that you are evicting your tenant, you must start by serving some type of notice.

The eviction process takes from 25 to 45 days depending on the amount of evictions the sheriff has to perform in a determined area. Our process will cut that time in half so you can assume control of your property faster.

Here is how the process works:

Step 1. Three Day Notice – This is the first step in the eviction process. You either post it yourself or have it serving by process server. The three day notice notifies the tenant to pay the rent in full or vacate the property within three business days. It is signed by landlord or property manager.

Step 2. Five Days Residential Evictions Summons and Complaint for Removal of Tenant – This must be served to the tenant.  A copy of the Three Day Notice and a copy of the lease must be
included as part of the package. A $185.00 filing fee must be paid at the court plus $10.00 fee for each summons served and $40.00 sheriff’s fee for each defendant.  This form must be served by the sheriff within 5-10 days or a private process server with in 48 hours or less to the tenant.  It lets the tenant know that they have 5 days to answer to the court the reasons why they should not be forced to move.

Step 3. Default Package – This package is file approximately 6-10 days after the service only if the tenant has not answered the court. This package includes Affidavit of Non-Payment of Rent which must be notarized, Non-Military Affidavit, Motion for Default, Final Judgment for Removal of Tenant, Writ of Possession. There is a fee of $115.00 payable to the sheriff in advance.

Step 4. Writ of Possession – The judge will sign a Writ of Possession after receiving the Default Package and then it will be delivered to the Sheriff.

Step 5. Eviction – The sheriff will post a note at the door informing the tenant the date they must move out and when the eviction will take place, usually within 2 to 10 days. The Sheriff will come back and evict tenant, everything will be removed from the premises and give possession of the property to the landlord.
